Supreme Court Case decision - RSL (Qld Branch) v Comprite Pty Ltd

Returned & Services League of Australia (Queensland Branch)

At 9.30am this morning his Honour HH Justice Chesterman handed down his decision in the Supreme Court Case of RSL (Qld Branch) v Comprite Pty Ltd (the Art Union Case). As with all decisions of single Judge, the decision is open to appeal within the prescribed time. Costs were awarded to the League.

At the time of writing the final orders favouring the League are yet to be determined by agreement by the parties. Failing agreement the Court will determine the appropriate orders. However, the following summary orders were made:

1. The defendant deliver to the plaintiff gaming and accounting records relating to the conduct of the plaintiff’s Art Unions.

2. The defendant’s counter claim is dismissed.

This decision represents a great deal of difficult and dedicated work by officers of the League, its staff and its legal advisors.

The future of the charitable works of the League is now assured.

Further details will be published to members at a later time.
